Insurance Coverage & Bad Faith

A substantial focus of our practice is the representation of insurance carriers in coverage and bad faith matters.  We have many years of experience in the interpretation of insurance policies and in rendering opinions on coverage, duty to defend, duty to indemnify, and other insurance contract related issues.  We serve both as coverage counsel and as litigation.  Frequently, these are complex, multi-party actions brought in either state or federal court. Our extensive experience in managing large cases has proven extremely valuable and in this regard.

Alaska bad faith insurance law requires insurers to deal with claims within certain time limitations.  These are set out in the Alaska Unfair Claims Practices Regulations.  

We represent insurers in all areas of insurance coverage and bad faith including claims arising under commercial general liability, homeowners, automobile, errors and omissions, medical, health, and officers and directors insurance policies.

Additionally, we have extensive experience in claims involving the appointment of independent counsel under AS 21.89.100 .

Our cases have involved coverage and/or bad faith claims arising from:

  • Construction defects in a $32 Million electrical cogeneration facility
  • Request for defense and indemnity under a homeowners policy against a claim of  setting fire to a multi-million dollar restaurant
  • Request for indemnity under a commercial general liability policy for suspicious damages to a $5 Million aircraft hanger located in a rural Alaskan community
  • Request for defense and indemnity under a homeowners policy for a shooting by minor resident of neighbor
  • Request for defense and indemnity under premises liability coverage for  an assault and battery by the owner upon a tenant
  • Bad faith failure to defend and indemnify under medical malpractice tail coverage policy.
