Recent Alaska Law Changes:

• February 2008 - Governor Palin signed House Bill 151 into law, an act requiring an indemnification, defense, and hold harmless provision in construction-related professional services contracts of state agencies, quasi-public agencies, municipalities, and political subdivisions.



• February 2008 – A prima facie case of employment discrimination based on age and race must be supported by substantial evidence that, among other factors, the applicant applied for and was qualified for the job.



• January 2008 – The Alaska Supreme Court decided the issue of whether an insured who exhausts the facial limits of the underlying policy is entitled to underinsured motorist benefits for amounts that were otherwise recoverable under the liability policy in the first instance.



• October 2007 – The Alaska Supreme Court decided a case involving claims of intentional infliction of emotional distress and spoliation, as well as the constitutionality of the Alaska Statute requiring the court to deposit fifty percent of a punitive damages award into the state’s general fund.

We have been involved in a number of insurance fraud matters with particular expertise in fire origin and cause analysis and arson investigations.
